(a) Pursuant to the authority granted to the Board of Certified Real Estate Appraisers pursuant to Wyoming Statutes § 16-3-101 to 16-3-115 and W. Section 2. Definitions. Terms defined in the act shall have the same meaning when used in these regulations unless the context or subject matter clearly requires a different interpretation.

(a) “Applicant” means a person or an Assessment management company (AMC) who submits an application for a permit or registration to the Board. This definition does not include temporary permits;

(b) “Appraiser Qualification Board” “AQB” is the independent board of the Appraisal Foundation that sets qualification standards for appraisers;

(e) “Certified general real estate appraiser” means a person certified by the Board to develop and deliver real estate appraisals for all types of property;

(f) “Certified residential real estate appraiser” means a person certified by the Board to develop and deliver real estate appraisals for all types of one to four unit residential property and vacant or unimproved land used for one to four residential unit purposes or which is the highest use and best is for one to four residential units, excluding subdivision assessments that require development analysis/assessment;

(g) “Board Director” means the executive director of the Wyoming Real Estate Commission who serves on the Board as an ex-officio non-voting member;

(h) “In good standing” means maintaining an active certification in this state pursuant to the Certified Real Estate Appraiser Act, which certification is not subject to any disciplinary sanctions or probation;

(j) “Jurisdiction” includes all fifty states and the commonwealth of the Northern Mariana Islands, Guam, Puerto Rico, the District of Columbia and the Virgin Islands as recognized by the United States.

(k) “Proof of completion” is a certified transcript or certificate from the entity offering the course/seminar stating the name of the appraiser, certified appraiser trainee, title of the course/seminar, and date of completion.

(l) “Registration number” means the unique number issued to each individual AMC. (m) “USPAP” means the Uniform Standard of Professional Appraisal Practice.

Section 3. Exceptions. These Rules and Regulations shall not apply to a real estate broker, associate broker or salesperson who, in the ordinary course of business, renders an opinion about the price of a property for the purpose of listing or prospective sale, provided, that this opinion price shall not be referred to as or be construed as an appraisal.

(b) AMC registration and renewal fees cover any changes made during the year such as, change of address and change of contact person. Forms for necessary changes must be submitted to the Board. All changes must be submitted to the Board within thirty (30) days. All AMC Federal Registration Fees must be paid at the time of AMC Application or Renewal in accordance with the rates and manner established by the ASC.

Section 5. Power of Public Records and Application of Uniform Rules. The commission is required under W.S. 16-3-103(j)(ii) to adopt uniform regulations of the Department of Administration and Information regarding procedures, fees, costs and charges for inspecting, copying, and producing public records. (i) The Commission has determined that incorporation of the full text in this rule would be cumbersome or inefficient given the length and nature of the rule;

(ii) Incorporation by reference does not include any subsequent amendment or edition of the matter incorporated beyond the applicable date identified in subsection (a) of this section, and;

(iii) The incorporated rules are maintained at the office of the Commission and are available for public inspection and copying at the same location.

(a) All applicants must attend a fifteen (15) hour national USPAP course covering the latest edition of USPAP or its equivalent, approved by the AQB Assessment Foundation, taught by an AQB certified USPAP instructor, and pass the relevant fifteen (15) hours nationality

(b) To qualify for a permit to practice as a certified general real estate appraiser, the applicant must provide evidence of successfully completing three hundred (300) creditable classroom hours of coursework, completed no more than sixty (60) months immediately prior to the filing of the application, in subjects related to property valuation that meet the required core curriculum established and published by AQB. In addition, applicants must possess a Bachelor’s, Master’s or Doctoral Degree from an accredited college/university acceptable to the Board of Directors.

(c) To qualify for a permit to practice as a certified residential real estate appraiser, applicants must provide evidence that they have successfully completed one hundred twenty-five (125) creditable classroom hours of coursework, spending no more than sixty (60) months at a time prior to the filing of the application, in subjects related to property valuation that meet the required core curriculum established and published by AQB. In addition, applicants must:

(i) Hold and provide evidence of successful completion, through official transcripts, of a Bachelor’s, Master’s or Doctoral degree from an accredited college/university acceptable to the Board of Directors; or,

(ii) Hold and provide evidence of successful completion, through official transcripts, of an Associate’s Degree from an accredited college/university acceptable to the Board of Directors in the field of focused study; or,

(iii) Provide evidence of successful completion, through official transcripts, of thirty (30) semester credit hours in a specific topic in an accredited college/university acceptable to the Board of Directors; or,

(iv) Provide evidence of successful completion, through official transcripts, of a College Level Examination Program (CLEP) examination equivalent to at least thirty (30) credit hours in a specific subject area attained at an accredited college/university acceptable to the Board of Directors ; or,

(v) Provide evidence of successful completion, through official transcripts, of any combination of completed semester credit hours and College Level Examination Program (CLEP) examinations attained at an accredited college/university acceptable to the Board of Directors.

(d) Distance education may be used as qualified education if the course is approved by the Board of Directors, meets the AQB criteria and has a controlled final exam upon completion.

(e) To qualify for a permit to practice as a certified appraiser trainee, the applicant must provide evidence of having successfully completed seventy-five (75) creditable classroom hours that meet the required core curriculum established and published by AQB, as well as , supervisor courses /trainer. All eligible education, except the supervisor/trainee course specified in Section 18 (l) of this regulation, must be completed within five (5) years prior to the date of submission of the certified appraiser trainee permit application.

(a) To be eligible to take the examination for certification as a certified residential real estate appraiser or certified general real estate appraiser, the applicant must submit evidence to the Board that the experience requirements have been met.

(b) To be certified as a residential real estate appraiser, the total experience must consist of one thousand five hundred (1,500) hours of experience gained within a period of not less than twelve (12) months. Although the number of hours may be accumulated, the required number of months must be accrued before an individual can be certified.

(c) To be certified as a general real estate appraiser, the total experience must consist of three thousand (3,000) hours of experience acquired in a period of not less than eighteen (18) months. Although the number of hours may be accumulated, the required number of months will accrue before an individual can be certified. At least fifty (50) percent of the appraisal experience shall be in non-residential appraisal work.

(a) Before taking the examination for a permit to practice as a certified real estate appraiser, the applicant shall provide evidence to the Board that the applicable education required by Section 5 and the experience required by Section 6 have been completed.
